Marks & Spencer suing Aldi over Colin the Caterpillar and Cuthbert copyright claims

M&S lodged an intellectual property claim over the similarities between Colin the Caterpillar and Cuthbert the Caterpillar. Marks and Spencer claims Aldi’s Cuthbert “rides on the coat-tails” on Colin.

M&S has asked Aldi to remove it Cuthbert product from sale.

A spokesperson for the supermarket said: “Because we know the M&S brand is special to our customers and they expect only the very best from us, love and care goes into every M&S product on our shelves.

“So we want to protect Colin, Connie and our reputation for freshness, quality, innovation and value.”

The spokesperson said M&S is taking “a targeted approach to protect our brand assets”.

He added: “We have got significant concerns about this product.”

Aldi has yet to respond to the claims.

Colin has been around for the past 30 years and is hugely popular.

The cake, with chocolate sponge, fondant and a chocolate coating has had many spin-offs.

There is an Easter Colin and Christmas Colin.

Colin wed in the past few years to another chocolate caterpillar cake with Strawberry flavouring named Connie.

Large versions of Connie and Colin were sold for wedding receptions.

Recently the brand released Colin the Caterpillar cupcakes. 

The treats are topped with rich chocolate buttercream, chocolate sprinkles, and mini white chocolate Colin the Caterpillar faces.

A limited-edition Easter Egg Hunt Colin the Caterpillar was sold this past Easter.

Posting a photo of the new Colin on the Marks and Spencer Food PR Instagram account, the caption read: “Colin has had an Easter makeover.

“Launching in-store today, the limited edition Easter Egg Hunt Colin is dressed up to the nines in his pink Easter hat, with gorgeous and delicious egg decorations.”

M&S has launched its £15 Italian Dine In deal.
